There are some states that will allow you to trespass in order to reach the defendant. You will have to do some research on your state to know whether that applies to yours or not though. Regardless of what the trespassing laws are in your state though there are no exceptions to breaking and entering. This is illegal no matter what state you’re in. Nor can you make them open the door even if you know their home. This means that you are not allowed to pretend to be law enforcement to try and get them to open the door. In either case, you will simple just have to come back at another time.

The dos of the job are all about being creative within the law. Most times when there is a defendant that is avoiding the lawsuit or case against them, they are going to be discrete about where they go and when. However, it’s nearly impossible to not leave the house for days on end anymore. This means that process servers will need to preform what you would call a stakeout. Whether you sit outside their home, their family’s home, or work, you can serve their papers once they come out. Just make sure that you are abiding by the laws when it comes to trespassing.
