The team that James Roland must put together to form Colorado Attorney Services is all about providing you with exceptional service. Here is how we do it.

The Dos and Donts as a Process Server

There are certain things that must be abided by when you’re a process server. Although they are there to serve legal documents it doesn’t mean that they have free reign to do as they please in order to make it happen. Colorado Attorney Services has ample experience when it comes to ensuring that the needed documents are served in a timely manner. Depending on the State, you may need someone who is certified as a process server to serve the documents, but this isn’t the case with every state. Therefore, we want to make sure that whether you are certified or not that you know what a process server can do and not do. This is for the protection of everyone involved.

There are some states that will allow you to trespass in order to reach the defendant. You will have to do some research on your state to know whether that applies to yours or not though. Regardless of what the trespassing laws are in your state though there are no exceptions to breaking and entering. This is illegal no matter what state you’re in. Nor can you make them open the door even if you know their home. This means that you are not allowed to pretend to be law enforcement to try and get them to open the door. In either case, you will simple just have to come back at another time.

The dos of the job are all about being creative within the law. Most times when there is a defendant that is avoiding the lawsuit or case against them, they are going to be discrete about where they go and when. However, it’s nearly impossible to not leave the house for days on end anymore. This means that process servers will need to preform what you would call a stakeout. Whether you sit outside their home, their family’s home, or work, you can serve their papers once they come out. Just make sure that you are abiding by the laws when it comes to trespassing.

There are many more dos and don’t when it comes to serving papers. This will require you to do research regarding your state laws and regulations. This would include whether you’re able to serve documents through mail and what to do when you have an evasive defendant. If you’re nervous about serving papers then call the professionals today! Colorado Attorney Services can serve any legal documents needed. We will be happy to work with you and provide excellent service in a timely manner.
