Many people do not have a clear understanding of what a subpoena is, which is exactly why we are tackling that subject here today.

What Exactly Is a Subpoena?

Literally translated, the term subpoena means “under penalty”. A subpoena is a court document that specifies a court order. This order will typically require some sort of action on your part, e.g. producing documents or giving a testimony in a trial. If the subpoena is ignored, there will be a penalty. A subpoena will include a court-imposed deadline wherein you will need to complete the action required.

Is There More Than One Type of Subpoena?

Yes. In fact, there are three types of subpoenas.

Witness Subpoena - A witness subpoena is used in trials. This type of subpoena will require you to be in court and make a testimony as a witness.

Subpoena Duces Tecum - This type of subpoena literally means “subpoena for production of evidence”. This type of subpoena will require you to deliver evidence relating to a case either by mail or in person.

Deposition Subpoena - This type of subpoena will require you to either answer questions about a case or deliver copies of business records pertaining to a case. These actions will be required before the trail begins as a part of the discovery process.

What If I Ignore a Subpoena?

As it translates, ignoring a subpoena will result in penalties. The most common penalty for ignoring a subpoena is being guilty of being in contempt of court. Then you can expect to have a hearing of your own where you will have an opportunity to explain yourself. Depending on your explanation, the court will decide an appropriate punishment. Usually this comes in the form of fines.
