But don’t run for your flashlight just yet! Because here’s the truth — when it comes to issuing a subpoena in support of an action outside the state of Colorado, it’s not as frightening as it sounds. Knowledge is power, and we’re here to help you turn legal terror into confidence.
Under Colorado Revised Statutes §13-90.5-103, any district court in Colorado has the authority to issue a subpoena for the appearance or deposition of a witness who lives or can be found here — even when the case itself is happening in another state.
Need documents too? No problem — this same statute allows the court to issue a subpoena duces tecum, which requires someone to produce evidence or paperwork.
So, if your out-of-state case suddenly needs a witness or documents from Colorado, you don’t need an exorcist — just the right paperwork.
The process is surprisingly accessible:
You just have to file in the county where the deposition or discovery will happen, and include a Foreign Subpoena (the one issued in another state).
Both are issued by the court clerk — no haunted rituals required.
Subpoenas issued under this statute must comply with §13-90-115, C.R.S. and Rule 45 of the Colorado Rules of Civil Procedure. In short: serve it right, or risk your subpoena disappearing like smoke in the night.
